Please read these Terms and Conditions carefully before using the hospo.work ltd service. By registering an account, accessing our platform, or using our services in any way, you agree to be legally bound by these terms. If you do not agree, do not use the service.
01 — About

About hospo.work ltd

hospo.work ltd (referred to throughout as “Hospo”, “we”, “us”, or “the Company”) is a company registered in England and Wales under company number 17067411. Our registered office is at 108A Roundwood Road, London, NW10 9UN. You can contact us by email at support@hospo.work.

Hospo operates an on-demand hospitality staffing marketplace. We connect vetted freelance hospitality workers (“Freelancers”) with hospitality venues (“Venues”) that need same-day or short-notice staffing. Our platform currently operates via WhatsApp Business and related tools, with a dedicated iOS and Android application planned for future release.

These Terms and Conditions constitute a legally binding agreement between you and hospo.work ltd. They apply to all users of our service, including Freelancers, Venues, and Venue Managers acting on behalf of a Venue.

02 — Definitions

Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

Term Meaning
AccountA unique account created for you to access and use our Service, whether as a Freelancer or Venue.
Company / Hospo / We / Ushospo.work ltd, company number 17067411, registered in England and Wales.
ContractThe legally binding agreement between hospo.work ltd and you for the supply of our Services, formed when you register an Account and accept these Terms.
FreelancerA hospitality professional registered with hospo.work ltd to find and accept short-notice shifts through our platform.
Personal DataAny information that relates to an identified or identifiable individual, as defined under applicable Data Protection Laws.
PlatformThe tools, systems, and channels through which hospo.work ltd delivers its Services, currently including WhatsApp Business and related tools, and any future application or digital interface.
Privacy PolicyOur separate policy document setting out how we collect, use, store, and protect your Personal Data, available at hospo.ltd/privacy-policy.
ServicesThe staffing marketplace services provided by hospo.work ltd, including the matching of Freelancers with Venues, shift coordination, and payment processing facilitation.
ShiftA specific period of paid hospitality work posted by a Venue and accepted by a Freelancer through the hospo.work ltd platform.
VenueA hospitality venue, business, or organisation registered with hospo.work ltd, acting through one or more Venue Managers, for the purpose of requesting and engaging Freelancers.
Venue ManagerAn individual who manages or owns a Venue and is authorised to make staffing and financial decisions on its behalf.
You / YourThe individual or entity accessing or using our Services, whether as a Freelancer, Venue, or Venue Manager.
03 — Eligibility

Eligibility and Account Registration

  • 3.1  You must be at least 18 years of age to register an Account and use our Services. By registering, you confirm that you meet this requirement.
  • 3.2  Freelancers must have the legal right to work in the United Kingdom. By registering as a Freelancer, you confirm that you hold the necessary permissions, visas, or entitlements to work legally in the UK. hospo.work ltd reserves the right to request evidence of your right to work and to suspend or terminate your Account if satisfactory evidence is not provided.
  • 3.3  Venues must be a legally incorporated entity or a sole trader operating lawfully in the United Kingdom.
  • 3.4  When registering an Account, you must provide accurate, complete, and up-to-date information. You must notify us promptly if any of your registration information changes.
  • 3.5  You are responsible for maintaining the confidentiality of your Account login credentials. You must not share your password with any third party. If you suspect unauthorised access, notify us immediately at support@hospo.work.
  • 3.6  hospo.work ltd reserves the right to refuse registration or to suspend or terminate any Account at our sole discretion, particularly where we suspect fraud, misrepresentation, or a breach of these Terms.
04 — Our Services

Our Services

  • 4.1  hospo.work ltd provides a technology-facilitated marketplace that connects Freelancers with Venues requiring short-notice hospitality staffing. We do not directly employ Freelancers, and we do not employ Freelancers on behalf of Venues.
  • 4.2  Our target fulfilment time — from a Venue submitting a shift request to a Freelancer being confirmed — is 30 minutes or less. This is a target, not a guarantee. Fulfilment depends on the availability of suitable, pre-vetted Freelancers at the time of the request.
  • 4.3  All Shifts offered through the platform are subject to Freelancer availability. hospo.work ltd does not guarantee that every shift request will be fulfilled.
  • 4.4  The quality and performance of Freelancers during a Shift is the responsibility of the Freelancer concerned. hospo.work ltd vets Freelancers prior to onboarding but does not guarantee the performance, skills, or conduct of any individual Freelancer during a Shift.
  • 4.5  hospo.work ltd may update, modify, or discontinue any aspect of its Services at any time. We will provide reasonable notice of material changes where possible.
  • 4.6  By using our Services, you consent to receiving operational messages, shift notifications, and service communications via WhatsApp and other digital channels. You can withdraw this consent at any time by notifying us in writing, though doing so may mean we are unable to provide the Services to you.
05 — Freelancer Terms

Terms Specific to Freelancers

5.1 — Self-Employment Status

Important — please read this section carefully. Freelancers using the hospo.work ltd platform are engaged as self-employed independent contractors. By registering and accepting Shifts, you acknowledge and agree to the following.
  • (a)  You are self-employed. You are not an employee, worker, or agent of hospo.work ltd or of any Venue.
  • (b)  You are responsible for your own tax affairs, including income tax and National Insurance contributions. hospo.work ltd and Venues will not deduct tax or National Insurance from any payments made to you.
  • (c)  You are responsible for any pension contributions you wish to make. No automatic enrolment applies to your engagement with hospo.work ltd.
  • (d)  You are not entitled to employment benefits such as holiday pay, sick pay, or redundancy pay in connection with Shifts taken through the hospo.work ltd platform.
  • (e)  Nothing in these Terms creates a relationship of employment, partnership, or agency between you and hospo.work ltd or between you and any Venue.
hospo.work ltd strongly recommends that Freelancers seek independent advice from an accountant or tax adviser. For information on self-assessment, visit gov.uk/self-assessment-tax-returns.

5.2 — Freelancer Obligations

  • 5.2.1  You must ensure that all information provided during registration, including your skills, qualifications, and experience, is accurate and truthful. Providing false information is a serious breach of these Terms.
  • 5.2.2  You must have the legal right to work in the UK for the duration of your use of the platform. You must notify hospo.work ltd immediately if your right to work status changes.
  • 5.2.3  Many Shifts involve the service of alcohol in licensed premises. You confirm you are of legal age and hold any licences required by law to perform the work described in a Shift posting.
  • 5.2.4  You are responsible for ensuring you have adequate personal insurance, including public liability insurance, to cover your activities during a Shift.
  • 5.2.5  You must attend every Shift you accept on time, dressed appropriately, and prepared to perform the work described. If you cannot attend a confirmed Shift, you must notify hospo.work ltd no later than 3 hours before the Shift is due to start.
  • 5.2.6  Repeated no-shows, late cancellations, or poor performance may result in suspension or permanent removal from the hospo.work ltd platform.
  • 5.2.7  You must conduct yourself professionally and lawfully during every Shift and comply with the reasonable instructions of the Venue.
  • 5.2.8  You must not undertake any work through the hospo.work ltd platform while under the influence of alcohol or any controlled substance.
  • 5.2.9  You must comply with all applicable health and safety legislation and with any health and safety instructions provided by the Venue.

5.3 — Freelancer Pay

  • 5.3.1  hospo.work ltd sets a minimum pay rate for all Shifts facilitated through its platform. This rate is based on the London Living Wage and includes a premium to reflect the short-notice nature of the work. The applicable rate for each Shift will be confirmed in the individual Shift notification sent to you.
  • 5.3.2  Payment to Freelancers is made by hospo.work ltd via bank transfer following confirmation by the Venue that the Shift was completed satisfactorily, within 5 working days of Shift completion.
  • 5.3.3  hospo.work ltd is responsible only for passing funds received from Venues to Freelancers. hospo.work ltd does not pay Freelancer wages from its own funds.
  • 5.3.4  In the event a Venue fails or refuses to pay hospo.work ltd for a completed Shift, hospo.work ltd will make reasonable efforts to recover the funds and keep you informed. However, hospo.work ltd cannot guarantee payment where the Venue does not make funds available.
06 — Venue Terms

Terms Specific to Venues

6.1 — Shift Requests and Pricing

  • 6.1.1  Venues request Shifts by contacting hospo.work ltd via our designated channels. All Shift requests should include the date, start time, expected end time, location, role required, and any specific requirements.
  • 6.1.2  hospo.work ltd charges Venues a single all-in hourly rate per Shift, which covers the Freelancer’s pay and hospo.work ltd’s platform fee. The applicable rate will be confirmed at the time of each Shift request. By submitting a Shift request, you agree to be charged at the confirmed rate.
  • 6.1.3  Rates may be subject to change. hospo.work ltd will provide reasonable notice of any changes to its standard rate structure. Any Shift that has been confirmed will be fulfilled at the rate agreed at the time of confirmation.
  • 6.1.4  Payment from Venues is required prior to a Freelancer being confirmed for a Shift. Confirmation is conditional on receipt of cleared payment.
  • 6.1.5  There are no subscription fees, retainers, or minimum commitments for Venues. You pay only for Shifts you request and that are fulfilled.

6.2 — Venue Obligations

  • 6.2.1  You must ensure that all Shift postings are accurate, including the role description, location, start and end times, dress code, and any specific requirements.
  • 6.2.2  You are responsible for providing the Freelancer with all information they need to attend the Shift, including the precise venue address, a contact name, and dress code.
  • 6.2.3  You must ensure that the workplace complies with all applicable health and safety legislation, and that the Freelancer is given an adequate induction before commencing work.
  • 6.2.4  You confirm that you hold all necessary licences, permits, and insurance required to operate your venue and to engage workers.
  • 6.2.5  You must treat all Freelancers with dignity and respect and must comply with all applicable anti-discrimination legislation, including the Equality Act 2010.

6.3 — Refunds and Non-Attendance

  • 6.3.1  If a Freelancer fails to attend a confirmed Shift without notice, hospo.work ltd will make reasonable efforts to find a replacement. If a replacement cannot be found, hospo.work ltd will refund the Venue the full amount paid for that Shift.
  • 6.3.2  No refund will be issued where a Freelancer attends but the Venue is dissatisfied with their performance. Performance disputes should be raised within 24 hours of the Shift ending. We may, at our discretion, offer a partial credit against a future Shift.
  • 6.3.3  No refund will be issued in respect of Shifts cancelled by the Venue within 3 hours of the scheduled start time. A cancellation fee may apply.
  • 6.3.4  Refund requests must be submitted in writing to support@hospo.work within 24 hours of the relevant Shift date.
07 — Payments

Payments, Fees, and VAT

  • 7.1  All fees quoted by hospo.work ltd are in pounds sterling (GBP). Fees include VAT at the rate applicable at the time of the transaction, where VAT applies.
  • 7.2  Payments from Venues are processed via Stripe, our third-party payment processor. By making a payment, you agree to Stripe’s terms of service, available at stripe.com/gb/legal.
  • 7.3  hospo.work ltd does not store credit or debit card details. All card data is handled directly by Stripe in accordance with PCI DSS standards.
  • 7.4  hospo.work ltd reserves the right to adjust its pricing with 14 days’ written notice to affected parties.
  • 7.5  In the event of a disputed charge, contact us at support@hospo.work. We will aim to resolve disputes within 5 working days.
08 — Platform Use

Platform Use and Communications

  • 8.1  By registering, you consent to receiving shift notifications, confirmations, and operational messages from hospo.work ltd via WhatsApp. Standard message and data rates from your mobile network provider may apply.
  • 8.2  You must not use our platform or communications channels to send spam, offensive content, or unsolicited messages to other users.
  • 8.3  You must not attempt to circumvent the hospo.work ltd platform to engage Freelancers or Venues directly in order to avoid hospo.work ltd’s platform fee. If we discover that a Venue has engaged a Freelancer introduced through hospo.work ltd outside of the platform within 12 months of their introduction, we reserve the right to invoice the Venue for the fee that would have been payable.
  • 8.4  hospo.work ltd is not responsible for the availability, reliability, or terms of service of third-party platforms used to deliver the Services.
  • 8.5  We may monitor platform communications for safety, compliance, and quality assurance purposes.
09 — Freelancer Vetting

Freelancer Vetting

  • 9.1  hospo.work ltd takes reasonable steps to verify the identity and experience of Freelancers before they are approved to accept Shifts.
  • 9.2  hospo.work ltd does not currently conduct criminal background or DBS checks as a standard part of onboarding. Venues who require DBS-checked workers should notify hospo.work ltd in advance.
  • 9.3  Vetting by hospo.work ltd does not constitute a guarantee of any Freelancer’s suitability, competence, or conduct. Venues are responsible for their own due diligence and for supervising Freelancers during Shifts.
10 — Intellectual Property

Intellectual Property

  • 10.1  All intellectual property rights in the hospo.work ltd platform, website, branding, software, databases, and content are owned by or licensed to hospo.work ltd. Nothing in these Terms grants you any right or licence to use hospo.work ltd’s intellectual property except as strictly necessary to access and use our Services.
  • 10.2  You must not copy, reproduce, distribute, modify, or create derivative works of any hospo.work ltd intellectual property without our prior written consent.
  • 10.3  By submitting any content or information to hospo.work ltd, you grant hospo.work ltd a non-exclusive, royalty-free, worldwide licence to use, display, and share that content for the purposes of operating and promoting the Services.
11 — Data Protection

Data Protection and Privacy

  • 11.1  hospo.work ltd is a Data Controller in respect of Personal Data it processes in connection with the Services. We process your data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
  • 11.2  Our Privacy Policy sets out in full how we collect, use, store, and protect your Personal Data. It is available at hospo.ltd/privacy-policy.
  • 11.3  By registering an Account, you consent to hospo.work ltd sharing necessary profile data with Venues for the purpose of facilitating Shift bookings. Financial information is not shared with Venues.
  • 11.4  You have the right to access, correct, or delete your Personal Data at any time by contacting support@hospo.work. You also have the right to lodge a complaint with the Information Commissioner’s Office (ICO) at ico.org.uk.
  • 11.5  Personal Data will be retained for as long as your Account remains active, and for up to 6 years after Account closure, after which it will be securely deleted or anonymised.
12 — Confidentiality

Confidentiality

  • 12.1  Each party agrees to keep confidential any information disclosed by the other party that is reasonably identified as confidential.
  • 12.2  This obligation does not apply to information that is publicly available, already known to the receiving party, required to be disclosed by law, or independently developed without reference to the confidential information.
  • 12.3  This clause survives termination of these Terms for a period of 2 years.
13 — Health & Safety

Health and Safety

  • 13.1  Venues are responsible for ensuring that their premises comply with all applicable health and safety legislation, including carrying out appropriate risk assessments and giving Freelancers an adequate induction before their Shift begins.
  • 13.2  Freelancers are responsible for taking reasonable care for their own health and safety and for reporting any safety concerns to the Venue without delay.
  • 13.3  Any accidents or incidents occurring during a Shift must be reported to hospo.work ltd at support@hospo.work within 24 hours.
14 — Limitation of Liability

Limitation of Liability

  • 14.1  Nothing in these Terms excludes or limits hospo.work ltd’s liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by law.
  • 14.2  Subject to clause 14.1, hospo.work ltd’s total aggregate liability to you shall not exceed the total amount of fees paid by you to hospo.work ltd in the 12 months preceding the event giving rise to the claim.
  • 14.3  hospo.work ltd is not liable for any indirect, consequential, or special loss; loss of profit, revenue, or goodwill; loss or corruption of data; or losses arising from your reliance on third-party services.
  • 14.4  hospo.work ltd is not responsible for the acts, omissions, performance, or conduct of any Freelancer during a Shift. hospo.work ltd’s role is limited to facilitating the introduction and managing the payment channel.
15 — Indemnity

Indemnity

  • 15.1  You agree to indemnify and hold harmless hospo.work ltd, its directors, employees, and agents from and against any claims, losses, damages, and costs arising out of or in connection with: (a) your use of the Services; (b) your breach of these Terms; (c) any act or omission during a Shift; or (d) your breach of any applicable law.
16 — Suspension & Termination

Suspension and Termination

  • 16.1  hospo.work ltd may suspend or terminate your Account immediately if: (a) you materially breach these Terms; (b) we reasonably suspect fraudulent activity; (c) you are subject to insolvency proceedings; or (d) continued access would cause harm to hospo.work ltd, other users, or third parties.
  • 16.2  You may close your Account at any time by contacting support@hospo.work. Closure will take effect within 5 working days.
  • 16.3  On termination, all accrued payment obligations remain enforceable. Clauses on liability, confidentiality, intellectual property, and governing law survive termination.
17 — Cancellation Rights

Cancellation Rights

  • 17.1  Where you are a consumer, you have statutory cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
  • 17.2  You have the right to cancel a contract for Services within 14 days of the contract being formed, without giving any reason.
  • 17.3  If you request that Services begin during the 14-day cancellation period, you may be charged a proportionate amount for Services provided before you cancel.
  • 17.4  To cancel, notify us in writing at support@hospo.work. We will acknowledge receipt promptly.
  • 17.5  Cancellation rights do not apply to Shifts that have been completed or partially completed, or to Shifts cancelled less than 3 hours before start.
18 — Force Majeure

Force Majeure

  • 18.1  Neither party will be liable for any failure or delay in performing its obligations caused by circumstances beyond its reasonable control.
  • 18.2  The affected party must notify the other party as soon as reasonably practicable and take all reasonable steps to minimise the impact.
  • 18.3  If a force majeure event continues for more than 30 days, either party may terminate the relevant Contract by written notice.
19 — Non-Discrimination

Non-Discrimination

  • 19.1  hospo.work ltd is committed to a fair and non-discriminatory platform. Neither Venues nor Freelancers may discriminate against any person on grounds protected under the Equality Act 2010.
  • 19.2  Venues must not request the replacement of a Freelancer on the basis of any protected characteristic. Any such request will be refused and may result in suspension of the Venue’s account.
20 — Ratings & Reviews

Ratings and Reviews

  • 20.1  Following a Shift, both parties may be asked to provide ratings and feedback. Ratings are used to maintain quality standards and may affect access to future Shifts.
  • 20.2  All feedback must be honest, fair, and factual. hospo.work ltd reserves the right to remove ratings that are abusive, discriminatory, or factually incorrect.
21 — Complaints & Disputes

Complaints and Disputes

  • 21.1  If you have a complaint, please contact support@hospo.work. We aim to acknowledge complaints within 2 working days and provide a full response within 5 working days.
  • 21.2  If a dispute arises between a Freelancer and a Venue, either party may contact hospo.work ltd to request informal mediation. Any mediated outcome is not legally binding unless agreed in writing by both parties.
22 — Changes to These Terms

Changes to These Terms

  • 22.1  hospo.work ltd may update these Terms from time to time. We will notify registered users by email and by posting a notice on our platform.
  • 22.2  Changes will take effect 14 days after notice is given. Continued use of the Services constitutes acceptance of the updated Terms.
  • 22.3  If you do not agree to updated Terms, you must stop using the Services and close your Account before changes take effect.
23 — General Provisions

General Provisions

23.1 Entire Agreement. These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and hospo.work ltd in respect of the Services.

23.2 Severability. If any provision is found to be invalid or unenforceable, the remaining Terms shall continue in full force and effect.

23.3 Waiver. A failure by hospo.work ltd to exercise any right under these Terms does not constitute a waiver of that right.

23.4 No Assignment. You may not assign your rights or obligations under these Terms without hospo.work ltd’s prior written consent.

23.5 Third Party Rights. These Terms do not confer any rights on any third party under the Contracts (Rights of Third Parties) Act 1999.

23.6 Governing Law and Jurisdiction. These Terms are governed by the law of England and Wales. Both parties submit to the jurisdiction of the courts of England and Wales. A customer resident in Scotland or Northern Ireland may also bring proceedings in the courts of Scotland or Northern Ireland respectively.
